Civil Law Definition And Overview

Civil law or European Continental law or Romano-Germanic law is the principal system of law in the world. Civil law is the legal tradition that derives from Roman law. The primary feature of which is that laws are written into a collection, codified, and not (as in common law) interpreted by judges. Civil law seeks to resolve non-criminal disputes such as disagreements over the meaning of contracts, property ownership, divorce, child custody, and damages for personal and property damage.

The body of laws of a state or nation deals with the rights of private citizens. The law of ancient Rome as embodied in the Justinian code, especially that which applied to private citizens. A system of law has its origin in Roman law, as opposed to common law or canon law. Unlike criminal law, Civil law regulates relationships amongst persons and organizations. Civil law, in this sense, is usually referring to redress to civil law courts (as opposed to criminal courts) and is often used as a means to resolve disputes involving accidents (torts such as negligence), libel and other intentional torts, contract disputes, the probate of wills, and trusts, and any other private matters that can be resolved between private parties.

Conceptually, it is the group of legal ideas and systems ultimately derived from the Code of Justinian, but heavily overlaid by Germanic, ecclesiastical, feudal, and local practices, as well as doctrinal strains such as natural law, codification, and legislative positivism. The function of civil law is to provide a legal remedy to solve problems. Sometimes civil law is based on a state or federal statute; at other times civil law is based on a ruling by the court.

In the United States, civil law has two meanings. One meaning of civil law refers to a legal system prevalent in Europe that is based on written codes. Civil law in this sense is contrasted with the common-law system used in England and most of the United States, which relies on prior case law to resolve disputes rather than written codes. The second meaning of civil law refers to the body of laws governing disputes between individuals, as opposed to those governing offenses that are public and relate to the governmentthat is, civil law as opposed to Criminal Law.

It is sometimes used in contradistinction to criminal, to indicate the private rights and remedies of men, as members of the community, in contrast to those which are public and relate to the government; thus we speak of civil process and criminal process, civil jurisdiction and criminal jurisdiction.

Pack more knowledge of law in your brain to do your duty and maintain your rights, just remember to be a good citizen.

Illinois Lawyers and Civil Litigation

Please note that all of the information contained in this article relates to Illinois civil litigation only.

If you have filed a lawsuit against another person or business, you are involved in civil litigation (“cl”). This differs from a criminal law case where the government always brings the legal action. In addition, in a criminal case, the government can often punish the losing party with jail time; in a civil case, the most common ending is one party paying the other. A few other civil remedies do exist, such as returning property or stopping some sort of behavior, but you can never put the other person in jail.

There are a huge variety of topics included in civil litigation. A broken contract, business conflicts, landlord/tenant issues and problems with a will are all forms of cl. These suits can revolve around a crime or injury, too. For instance, if a drunk driver in Chicago injures you in a car accident, you could bring a claim at the Daley Center against the person to receive compensation for your injuries. This is true even if the State of Illinois brings a criminal case against that person for drunk driving and puts them in jail. Its also true if the Illinois criminal judge were to order the defendant to pay you restitution.

Since civil litigation includes virtually any topic that is not criminal, most civil lawyers choose a specific topic to focus on, like divorce cases or personal injury, instead of trying to take any civil law case. You should be sure to find a lawyer who specializes in your legal issue. If you are bringing a suit because you have been injured, usually an Illinois personal injury lawyer will take your case on a contingency. This means you wont have to pay any upfront fee or ongoing rate; instead, your lawyer will recover a portion of any money you get from the other side at the end of the case. Other attorneys will have different fee arrangements. If you have business or contract issue, usually the lawyer will charge an hourly rate to work on your case. In addition, the lawyer will probably charge a retainer an upfront fee you pay to officially hire the lawyer. If you are the defendant in a case, you will virtually always pay your lawyer a retainer and hourly rate. That said, in Illinois when you are sued and have insurance that hires a lawyer for you, the insurance company pays all of the law firm fees.

There are many rules and regulations that determine how and when you can bring your lawsuit, including strict timelines of when to take certain actions. A civil attorney experienced with your legal issue will know how to properly move your case through the process. If you dont meet all of these timelines, you can lose the case even if you would have otherwise won. Also, each civil law issue has a statute of limitations, this is the deadline by which you must start your lawsuit, or you may be prevented from ever bringing the case in the future. For example, most Illinois car accident claims must be filed with a county court within two years from the accident date.

French Wedding For Eva And Tony – Paris Mayor Conducts Civil Cermeony

The star of “Desperate Housewives” star Eva Longoria and her toyboy beau Tony Parker NBA champion exchanged vows in a civil ceremony in Paris on Friday, as required by french law even when a couple have a church wedding as well.

The civil ceremony took place before a modest crowd of about 40 guests, including French soccer player Thierry Henry and some of Parker’s teammates from the San Antonio Spurs. The ceremony was held at Paris’ City Hall at the 4th District Town Hall with the mayor of Paris pronouncing them husband and wife.

After arriving in a white stretch limo to the civil ceremony, a pretty-in-pink Eva, 32, in a way-above-the-knee Chanel dress with striped black and white straps was spotted waving to the crowd of over 1000 fans before heading into the municipal building.

Eva arrived first and was accompanied by about eight guests in cream, pink and purple dresses. She turned, smiled and waved for the crowd of waiting photographers and reporters who were kept well back behind two rows of police barriers. Inside Eva changed in Bertinotti’s office into a short white dress for the ceremony.

Tony Parker, who was born in Belgium and grew up playing basketball in France, arrived about 10 minutes later wearing a dark suit. He went straight in without waving.

In between, other guests arrived in a Humvee stretch limo

Paris Mayor Bertrand Delanoe officiated and gave a speech saying how happy he was that they were married in the City of Light, said the mayor of Paris’ 4th District, Dominique Bertinotti.

“I married a friend to the woman he loves. It was touching, moving, very warm and at the same time very relaxed, Delanoe said on RTL radio Saturday.

Parker translated Delanoe’ speech into English for the guests, who numbered about 40.

The ceremony, in a room with blue-and-white trimmed walls, a French flag and a portrait of French President Nicolas Sarkozy, lasted about 45 minutes. Bertinotti said there was a small reception afterward that also lasted about 45 minutes.

Celebrities guests included Longoria’ Desperate Housewives castmates, Michael Douglas and Catherine Zeta-Jones, Jamie Foxx, Lopez and Parker’s San Antonio Spurs teammates. Fellow housewives Teri Hatcher, Felicity Huffman and Nicolette Sheridan reportedly arrived Friday at Paris’ Bourget airport in a private jet. Marcia Cross, who stars in the series as Bree and recently gave birth to twins, is not expected to attend the wedding.

The couple left in a black Mercedes sedan with tinted windows.

The celebrity couple then held a second, more lavish wedding ceremony on on the auspicious date of 7th July 2007 at Eglise Saint-Germain l’Auxerrois, in a Paris cathedral dating to the 12th century. The church, which is located near the Louvre Museum, once served the French royal family. Media interest was intense and residents nearby purportedly charged television companies 2,500 euros or about 3,400 US dollars to use their balconies. Paparazzi were circling and it was a game of cat and mouse

The religious ceremony was followed by an exclusive, star-studded bash at Chateau Vaux-le-Vicomte, a chateau southeast of Paris.

You do not have to be rich and famous to get married in France. Anyone can have their very own fairytale french wedding.
